Sounds to me like Ben Adler, who wrote that opinion piece, forgets one other thing that Obama can still do to legalize gay marriage - appoint Supreme Court Justices who will overturn state and local laws against it, as was done in the past with laws against interracial marriage.
And you’re wrong, In the case ofLoving v. Virginiathe United States Supreme Court ruled that all bans on interracial marriage were unconstitutional. A constitutional amendment states that marriage is between a man and woman.
At this time, there is no constitutional amendment stating marriage is between a man and a woman at a federal level. The Republican party would like for there to be one, but it doesn’t exist yet. DOMA is an Act, not an Amendment. As things stand now, if Obama appoints Supreme Court Justices who overturn existing bans on gay marriage at the state level, gay marriage will become the law of the land, exactly as interracial marriage became the law of the land after Loving v Virginia overturned existing state-level bans on it.
